Rental Agreement and Policies
A Reservation/Damage Deposit is due upon booking a reservation.
It is not refundable due to cancellations made less than 45 days prior to check in.

Release and Indemnity Agreement For Short Term Nightly Rental


___________________________________________, hereinafter "Guest(s)" on the behalf of any and all persons occupying and/or visiting the subject premises during the rental period does forever release, acquit and discharge GuadalupeRentals.com or anyone representing GuadalupeRentals.com hereinafter "Agent", and all other persons, firms, or corporations who might be liable, from all claims, demands, charges, costs of court, including attorney's fees and causes of action of whatever nature from all liability and damage of any kind, whether in contract or in tort.

Should Agent have a claim made against either or both of them, Guest(s) agree(s) to indemnify and defend Agent for any such claim and/or lawsuit. Further, in the event that a claim and/or lawsuit arises out of the subject rental, and Guest (s) has (have) a policy of insurance, Agent shall be considered insured's, and/or Agent shall enjoy the benefits of such an insurance policy as though they were named insured's.

Any dispute arising from the rental shall be governed and construed by the laws of the State of Texas. Venue for any dispute shall be in Comal County, Texas; and any such dispute shall be adjudicated by binding arbitration. The costs and expenses of arbitration shall be shared equally by the parties and each party shall be responsible for its own attorney's fees.

If any part of this Release and Indemnity Agreement is invalid, the remaining portions shall remain in full force and effect.

I (we) have read and understood this Release and Indemnity Agreement, and have signed this Release and Indemnity Agreement without any advice, recommendation, and/or inducement from Agent.


POLICIES AND PROCEDURES


GUESTS: The registering guest is responsible for the conduct and financial of everyone in their group.
Occupancy: "Guest (s)" must comply with the maximum number of guest per unit as stated here: Casa Grande Guadalupe 16, Guadalupe Haus 16, Casita Guadalupe 12, Cabana Guadalupe 12, Comal River Condos at Inverness 6. The maximum occupancy for each unit is highly monitored. GuadalupeRentals.com has the right to inspect the number of people in your party. There is a $50 charge per person per night exceeding the guest limit. Please notify GuadalupeRentals.com of any visitors. Failure to disclose any party exceeding the maximum occupancy is reason for eviction without reimbursement of rents or deposits.

CANCELLATIONS/REFUND: A $125.00 cancellation/administrative fee is charged for any reservation that is cancelled after booking with GuadalupeRentals.com.

Cancellations for nightly rentals must be made in writing no less than 45 days prior to check in date for refund less $125.00 administration fee. (B) Cancellations for long-term rentals (two or more weeks) must be made in writing no less than 60 days prior to check in date to qualify for refund less $125.00 fee. (C) No refund for cancellation under any circumstances if cancellation guidelines are not met by Guest. (D) Reservations are not contingent upon availability or conditions of the water recreational facilities, including but not limited to the Comal and Guadalupe River or Schlitterbahn. (E) There will be NO REFUNDS for shortened stays; you must pay for what you book.

RESERVATION/DAMAGE DEPOSIT: A $300.00 Reservation Damage Deposit on all Comal River rental Condo's and $500.00 on all Guadalupe River houses due within 24 hours of making reservation, refundable (7) days after check out provided the following provisions are met:
-No damage is done to RENTAL PROPERTY or its contents, beyond normal wear and tear.

-No charges incurred due to excessive cleaning.

-All debris, rubbish, garbage and discards are placed in assigned dumpsters, and dishes are left clean.

-All windows/doors are closed and locked: All keys are left in the lockbox.

-No Indoor/Outdoor furnishings are moved from original position, lost or damaged.

-No missing items from units.

-Guest vacated property promptly at check out time 11 a.m. late checkout will result in loss of deposit in addition after 1 p.m. Guest will be charged 1 (one) FULL DAY to your credit card on file.

-Absolutely no smoking inside units.

-Absolutely no pets allowed on the grounds or inside any unit.

-Any party exceeding the maximum occupancy is reason for eviction without reimbursement of rents or deposits.

-Excessive partying, vulgarity, smoking, nudity, non-registered visitors excessive vehicles, loud music, fireworks, ground fires, or a police call can result in the loss of deposit and/or eviction without refund.

RENTAL FEES: Nightly Rentals: The final balance is due no less than 14 days prior to check-in, reservation will be canceled with no refund if not paid by posted date. Rentals 14 days or longer the balance is due 60 days prior to check in date. A signed "Rental Agreement and Policies & Procedures" (Release and Indemnity Agreement) must be on file before Check In/Out Instructions are provided. Failure to comply does not release financial responsibility. You will pay for what you have booked including any deposits made.

THERE WILL BE NO REFUNDS based on failure to comply.

REFUNDS: Refunds will be processed through the same procedure the rental payment was made 7 days after check out.

Early Departure: GuadalupeRentals.com does not refund money for early departures for any reason.

In the event of unforeseen circumstances, we reserve the right to try and accommodate Guest (s) with another property or cancel reservation with refund of full deposit prior to check in.

Reservations/Refunds are not contingent upon availability or conditions of the water recreational facilities including but not limited to the Comal and Guadalupe Rivers or Schlitterbahn. There will be NO REFUNDS for shortened stays; you must pay for what you book.

We reserve the right to ask Guest (s) to vacate property or ask law enforcement to remove guest without refund for verbal abuse or threatening remarks or actions of any kind. Excessive partying, vulgarity, smoking, nudity, non-registered visitors, excessive vehicles, loud music, fireworks, ground fires.

NON-SMOKING: All properties are non-smoking units. Any evidence of smoking (smell, ashes, etc.) of this rule being violated you will forfeit the full Reservation Damage Deposit. Outside smoking is permitted but please dispose of all debris properly and keep doors closed. Please be considerate of our properties.

NO PETS ALLOWED: Absolutely no pets are allowed inside or outside our properties under any conditions. If this rule is violated you will forfeit the full Reservation Damage Deposit. If evidence of pet was on property you will be accessed a fee of $300.00 in excess of Reservation Damage Deposit.


INVENTORY: A full written inventory as well as a videotaped inventory has been taken of each property and it's contents, an inspection will be made after your check out. Any damage or missing items will be charged to your credit card. GUADALUPERENTALS.COM inspects each rented unit upon departure and prior to arrival.

FAIR HOUSING: GuadalupeRentals.com complies with all Fair Housing requirements and will not deny any rentals because of race, color, religion, sex, origin, handicap or family status. We reserve the right to not rent to vacationing students or singles under the age of 25 years of age without a $300/person Damage Deposit. Registering Guest will be responsible for all excess charges and damage fees.

KEYS AND LOCK OUT PROCEDURES: All keys issued at check in must be returned at check out. There will be a $25 charge for each key we have to replace. After-hour lockouts result in a $75 lockout fee. There will be a lockbox with the keys inside at each property. This information will be give to you by management upon receipt of Final Balance.


PARKING & VEHICLE REQUIREMENTS: Parking Permits for each rental will accompany Check In/Out Instructions, please adhere to all rules. The Comal River Condo's @ Inverness units are limited to 1 reserved parking space and 1 parking permit in the open lot per unit. Parking at the Guadalupe River houses: Casa Grande Guadalupe 8, Guadalupe Haus 8, Casita Guadalupe 4, Cabana Guadalupe 6.

WATER AND SEPTIC: PLEASE DO NOT FLUSH anything other than toilet paper. No feminine products or baby products should be flushed at anytime. If it is found that feminine products or baby products have been flushed and clogs the septic/plumbing system, this will result in loss of the full Reservation Damage Deposit in addition to any licensed plumber expense.

PATIO/BALCONY/ENTRY AREAS: Patios, balconies and entry areas must be kept free from items that could be a hazard. Please do not hang towels over balcony railings. For safety reasons, balcony loads should not exceed room occupancy and NO horse playing on balconies. By City Ordinance: NO GRILLING from balconies of any units. No ground fires, Bonfires or private grills. Where applicable fire pits are available.

SAFETY: Safety and security are the sole responsibility of the guests. Owner or its agent assume no responsibility or liability for the safety or security of the guests, or for the injury caused by the criminal acts of other persons. Guests should ensure that all doors and windows are locked at all times. Guests must immediately notify GuadalupeRentals.com if any locks are inoperative. Guests should turn off any appliances when leaving the premises and not store combustibles on premises.

LOST AND FOUND: We are not responsible for any loss of money, jewelry, valuables of any kind or any damages incurred to guests' vehicles or their contents. GuadalupeRentals.com will hold any left behind items for two weeks. After two weeks it will be discarded. Left-behind items will be returned at guest's expense upon request via mail.

PAYABLE: The guests acknowledge receipt of the services and charges hereon and agree to pay for it on demand in New Braunfels, Comal County Texas. These properties are privately owned, and the management reserves the right to refuse service to anyone.

WATER SAFETY: No lifeguards are on duty at properties. You swim and enter river (s) at your own risk. ABSOLUTELY NO DIVING OR JUMPING FROM PIERS OR RIVERS EDGE, CONSTRUCTION OF SWINGING OR DIVING FROM TREES.

Armbands: Armbands must be WORN for guest at the Comal River Condos at Inverness. These are found in the unit please mark with your departure date. Onsite security strictly enforces this along with all city and HOA property rules.

Noise Ordinance: The City of New Braunfels has a strict 10 p.m. noise ordinance.

Check In/Out Instructions: Guest will be emailed the Check In/Out Instructions upon payment of final balance and receipt of the signed "Rental Agreement and Policies & Procedures" (Release and Indemnity Agreement) and Guest Log. These must be on file before Check In/Out Instructions are provided. Failure to comply does not release financial responsibility. You will pay for what you have booked.. THERE WILL BE NO REFUNDS based on failure to comply this includes any deposits made. There are 2 after hours telephone numbers listed on the Check In/Out Instructions should you need to contact GuadalupeRentals regarding issues needing addressed after office hours.
